California Consumer Privacy Act Disclosures
This notice is from KLA Corporation and its affiliates (“KLA,” “Company,” or “us”) and is intended for California residents (“you”). It explains how we handle your personal information in accordance with the California Consumer Privacy Act (CCPA) and should be read together with the KLA.com Privacy Notice. The terms used here have the same meaning as in the CCPA. These disclosures do not reflect our collection, use, or disclosure of California residents’ personal information, or data subject rights, where an exception or exemption under the CCPA applies. Our CCPA Disclosure describes how we collect and use personal information from individuals who interact with us, both online and offline, including representatives of customers, suppliers, investors, partners, and candidates for employment.
If you are a candidate, this notice should be read with the KLA Candidate Privacy Notice, which also applies to you.
If you are an employee, this notice should be read with the Employee Privacy Notice, which also applies to you.
California Consumer Privacy Act Privacy Notice
PERSONAL INFORMATION WE COLLECT AND HOW WE USE IT
KLA collects and uses different types of personal information to support business operations and comply with legal requirements. The following outlines the types of personal information we collect, and have collected in the last 12 months, and how each is used:
- Identifiers (name, address, email, etc.):
Used to identify you, verify your identity, manage your account and our business relationship, communicate with you, and provide services. - Internet or other electronic network activity information (IP address, device ID):
Used to operate and secure our websites, personalize content, analyze usage, measure marketing effectiveness, and improve your experience. - Commercial information (purchase history):
Used to fulfill orders, provide customer service, and improve products and services. - Geolocation data (city, country, IP-based):
Used to enhance website security, comply with laws, and personalize your experience. - Audio, electronic, visual, thermal, olfactory, or similar information (calls, video, images):
Used to support communications, training, and security. - Professional or employment-related information:
Used to manage our relationship with you as a customer, supplier, or job candidate. - Education information:
Used to verify qualifications for employment or partnership. - Sensitive Personal Information (SSN, ID numbers, race, Contents of a consumer’s mail, email, and text messages (unless the business is the intended recipient), etc.):
- Used to fulfill legal and regulatory obligations, including equal opportunity requirements, verify identity, manage employment and business relationships, and conduct audits, investigations, or other legitimate business activities.
We may use your personal information collected online for the following business and commercial purposes:
- Provide and improve our products and services
- Communicate with you and respond to your requests
- Manage our business and relationships
- Comply with laws and regulations
- Protect our company and users
- Conduct audits, investigations, and handle legal requests
- Personalize your experience and measure marketing effectiveness
RETENTION
We keep your personal information for as long as you have a relationship with us, as required by law, or as needed to protect our legal rights and manage our records.
HOW WE COLLECT PERSONAL INFORMATION
KLA collects personal information from and about the Websites’ users, both directly when you provide it and automatically while you visit the Websites, as follows:
- Directly from you: For example, when you contact us or we contact you to request information including via the KLA websites or when you apply for a position at KLA, or during the course of your engagement with KLA.
- Third Parties, including Service Providers and Data Brokers: For example, service providers that KLA uses and other third parties, some of whom could be considered Data Brokers, that KLA chooses to collaborate or work with.
- Using cookies and automatic collection methods: KLA and its service providers may collect information from the computer, tablet, phone, or other device that you use to access our websites, or that you use to open an email from KLA.
DISCLOSURE OF PERSONAL INFORMATION
We may disclose, and have disclosed in the last 12 months, your personal information with others as part of our business operations and to comply with the law:
- KLA Affiliates: Made available only to those who need access for authorized purposes and /or required by law in the Company, locally and overseas, such as KLA human resources personnel, relevant business managers, authorized members of internal control functions, and individuals from information technology, finance, payroll and stock departments.
- Third parties and service providers: KLA uses third parties or service providers to provide administrative or other services to the Company, who have a duty of confidentiality to us. Examples of such parties include travel service providers, payroll administrator, and employee benefit providers.
- Authorities and Legal Requests: We may disclose your personal information to government authorities, regulators, or law enforcement when required to do so by law, regulation, or legal process.
SALE OR SHARING OF PERSONAL INFORMATION
Your information is not “sold” or “shared” for monetary consideration, but certain uses may be considered “sale” or “sharing” of personal information under the CCPA.
We may share, and have shared in the last 12 months, personal information such as device information and characteristics, browser information, user behavior and interaction with the sites, browsing behavior, and interaction with ads with third parties to provide analytics. If you choose to opt-in, we may also serve ads on our behalf targeted to your interests and based on your online activities. Information may be linked to your browser or device (like cookies and similar tracking technologies).
To change these settings, click the “Do Not Sell/Share My Personal Information” link located at the bottom of our website and follow the directions to opt-out of these uses of your personal information. You can also opt-out by enabling the Opt Out Preference Signal, including the Global Privacy Control signal, available in certain browsers and extensions, and we will treat that signal as a valid opt-out request. Because some technologies operate differently by website and device, you may need to take this step to opt-out on additional websites and devices you use.
Please note that KLA does not engage in the offline “sale” of your personal information as defined by CCPA.
We do not knowingly sell or share for cross context behavioral advertising the personal information of California residents under 16 years of age.
PURPOSE FOR COLLECTION
We may use your personal information collected online for the following business and commercial purposes:
- To draw inferences from potential candidates about their abilities and aptitudes for a possible match to our job descriptions. Please see the Global Career Site Privacy Policy details relevant to candidates.
- Administer, facilitate, and improve operations of our websites.
- Provide firmware or software updates.
- Measure and understand the effectiveness of our marketing campaigns, and market and advertise our products and services to you.
- Engage in research and development efforts to assess the performance of our products and services, analyze usage, interests, and trends in connection with our products and services, improve and personalize our products and services, and develop new products and services.
- Monitor and enhance the safety and security of our websites, including preventing fraud or other unauthorized or illegal activity.
- Conduct internal audits and investigations.
- Handle and record consumer rights requests, including opt-ins and opt-outs.
- Comply with laws, regulatory requirements, and KLA’s Standards of Business Conduct, as well as respond to lawful requests, court orders, and legal processes.
- Send you administrative information, including information about our websites and changes to our services, terms, conditions, or policies.
SENSITIVE PERSONAL INFORMATION
We may collect Sensitive Personal Information as defined under the CCPA/CPRA, as outlined in Section PERSONAL INFORMATION WE COLLECT AND HOW WE USE IT. This information is used solely for purposes that the law recognizes as permissible and that do not require offering consumers the right to limit its use or disclosure. Accordingly, we do not provide a “Limit the Use of My Sensitive Personal Information” link, as our processing of Sensitive Personal Information is restricted to such permitted purposes.
YOUR RIGHTS
As a California resident, you have the following rights under the CCPA:
- Right to Know: You can ask what personal information we have about you, where it came from, why we collected it, who we shared it with, and see the specific information we hold. You can make this request up to twice in a 12-month period.
- Right to Delete: You can ask us to delete your personal information, with some exceptions.
- Right to Correct: You can ask us to fix any inaccurate personal information we have about you.
- Right to Opt Out: You can tell us not to sell or share your personal information.
- Right to Limit Use of Sensitive Information: You can ask us to limit how we use and share your sensitive personal information. We only use or share this information for reasons allowed by law.
- Right of No Retaliation: We will not retaliate or discriminate against you for exercising your privacy rights under the CCPA.
HOW TO EXERCISE YOUR RIGHTS
Methods of Submission and Instructions. To submit a request to exercise your rights to know, delete, or correct your personal information, please email privacy@kla.com, call +1 888-278-3169 (toll free), or populate our web form here.
Verification. You, or an agent that you authorize, can make a request about your personal information. To protect your privacy, we may ask for information to confirm your identity or your agent’s authority for a request to know, delete, or correct your personal information. If we cannot verify who you are, we cannot process your request. We will use any information you provide only to verify your identity and handle your request.
Authorized Agents. You can choose someone to act as your authorized agent and make a request for you if:
- The agent is a person or business, and you give them signed permission to act for you.
- You confirm directly with us that you gave this permission.
If you give your agent power of attorney under California law, you may not need to take these extra steps.
SHINE THE LIGHT DISCLOSURE
The California “Shine the Light” law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes. We do not share your personal information with third parties for their own direct marketing purposes.
